1. Business use only
TradeQuoteBuilder is built for contractors, trades businesses, estimators, construction professionals, and other commercial users. You must be at least 18 years old and legally able to enter into a binding agreement to use the service.
2. What the service does
TradeQuoteBuilder provides software for creating and managing estimates, quotations, proposals, job records, reusable materials, labour roles, crew presets, conditions, templates, measurements, scope items, exclusions, assumptions, payment terms, and related quote settings.
The service can calculate estimated material, labour, overhead, profit, tax, discount, deposit, and project amounts based on information entered or configured by users. Features may be added, changed, limited, suspended, or discontinued over time.
3. Software only, not professional advice
TradeQuoteBuilder is a software provider. It does not provide construction, engineering, architectural, inspection, legal, tax, accounting, insurance, employment, safety, code-compliance, or financial advice.
TQB does not inspect jobsites, verify measurements, confirm material coverage, supervise work, guarantee quote accuracy, or become a party to any agreement between a contractor and their client.
4. Estimates and calculations
All calculations depend on user-entered measurements, quantities, waste percentages, rates, yields, crew settings, taxes, overhead, markup, profit, access conditions, discounts, deposits, and other assumptions.
Before sending or relying on any quote, proposal, estimate, job record, profitability calculation, or other output, you are responsible for independently reviewing and verifying it.
- confirm measurements, quantities, materials, rates, taxes, permits, and site conditions;
- review scope, exclusions, assumptions, warranties, payment terms, cancellation rights, and required notices;
- verify the final price, deposit, schedule, and commercial terms; and
- retain records required for your business, client, or jurisdiction.
5. Accounts, workspaces, and authorized users
You must provide accurate account information and keep it current. You are responsible for keeping login credentials secure and for activity under your account, except where caused by TQB's breach of these terms or applicable law.
Workspace owners and administrators are responsible for deciding who may access a workspace, assigning permissions, removing access when needed, and ensuring invited users follow these terms.
6. Customer data
Customer data means information, files, photos, records, settings, text, and other material submitted to or generated through the service by or for a customer.
As between TQB and the customer, the customer retains ownership of customer data. The customer gives TQB and its service providers a limited licence to host, process, transmit, display, back up, secure, support, and use customer data only as reasonably necessary to provide and improve the service, prevent abuse, comply with law, and enforce these terms.
7. Customer responsibility for personal information
Customers may enter personal information about clients, prospects, property owners, employees, subcontractors, and quote recipients. Customers are responsible for having the required rights, notices, consents, and lawful reasons to collect and enter that information.
Unless TQB expressly agrees in writing, customers must not use the service to store highly sensitive information such as government identification numbers, complete payment-card numbers, protected health information, biometric templates, criminal-history records, or passwords for third-party systems.
8. Quotes, clients, and construction contracts
Any quotation, proposal, estimate, change order, acceptance, or job contract created through the service is between the customer and the customer's client. TQB is not the contractor, client, employer, supplier, payment guarantor, architect, engineer, insurer, or project manager.
Customers are solely responsible for their quote and contract terms, workmanship, safety, staffing, scheduling, materials, subcontractors, permits, warranties, taxes, refunds, disputes, and compliance with applicable law.
9. Electronic records and acceptance
The service may allow a quote recipient to view a document, check a box, type a name, click an acceptance button, provide an electronic signature, or take another electronic action.
Customers authorize TQB to create and maintain electronic records of those actions, which may include document version, date and time, name, email address, IP address, user agent, and related technical information. Customers are responsible for deciding whether the acceptance method and document content satisfy applicable legal requirements.
10. Subscriptions, trials, and billing
Some features require a paid subscription. Current plans, prices, billing periods, included features, usage limits, taxes, and trial terms are shown at checkout or in the account billing area.
Unless checkout states otherwise, subscription fees are charged in advance and automatically renew until cancelled. You authorize TQB and its payment processor to charge the payment method on file for subscription fees, applicable taxes, and disclosed charges.
Trials, if offered, are governed by the trial details shown when the trial begins. If a trial converts automatically to a paid subscription, the conversion price and date will be shown before the trial begins.
11. Cancellation, downgrades, and refunds
You may cancel through billing settings or by contacting support@tradequotebuilder.com if self-service cancellation is unavailable.
Unless checkout or applicable law states otherwise, cancellation stops future renewal and takes effect at the end of the current paid billing period. Fees already paid are non-refundable and no credits are provided for partial periods, unused features, or reductions in usage, except where required by law or expressly agreed in writing.
12. Acceptable use
You must not use the service to violate law, misrepresent qualifications, impersonate others, upload malicious code, access another workspace, bypass security, expose secrets or service-role keys, circumvent plan limits, send unlawful commercial messages, or create material security, legal, or reputational risk.
TQB may investigate suspected violations and may remove content, limit functionality, suspend access, or cooperate with lawful authorities where reasonably necessary.
13. Intellectual property
TQB and its licensors own the service, software, design, interfaces, branding, documentation, and related intellectual-property rights. Subject to these terms and payment of applicable fees, customers receive a limited, non-exclusive, non-transferable right to use the service for internal business operations during the subscription term.
Customers may use, download, print, and provide to clients the quotes and documents generated from their own customer data.
14. Third-party services
The service relies on third-party hosting, database, authentication, payment, email, monitoring, and infrastructure providers. Third-party services are governed by their own terms and privacy practices. TQB is not responsible for third-party products, outages, account decisions, or changes outside TQB's reasonable control.
15. Security and availability
TQB maintains reasonable administrative, technical, and organizational safeguards appropriate to the nature of the service and information processed. No online service is completely secure or uninterrupted.
Customers are responsible for secure devices, browsers, networks, passwords, workspace permissions, exports, and backups of records they are legally or commercially required to retain.
16. Data export, account closure, and deletion
Customers should export important records before closing an account or allowing a subscription to expire. Account deletion requests may be made through available settings or by contacting support@tradequotebuilder.com.
Deletion may be delayed or limited where information remains in backups, must be retained for billing, tax, fraud-prevention, security, legal, or compliance reasons, is held by quote recipients or other users, or has been de-identified.
17. Warranties, disclaimers, and liability
The service is provided on an as-is and as-available basis to the maximum extent permitted by law. TQB does not guarantee uninterrupted operation, error-free calculations, profitable jobs, accepted quotes, enforceable contracts, or successful collections.
To the maximum extent permitted by law, TQB is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or business opportunities.
